If the application is successful, EU citizens will benefit from either a regulated status (with a permanent right of residence) or a pre-regulated status (stay of less than 5 years). The non-demand of the scheme could lead to estrangement. EU citizens and British citizens entering the host state during the transition period enjoy the same rights and obligations under the withdrawal agreement as those who arrived in the host state before 1 February 2020. The right of every EU citizen and his or her family to live, work or study in an EU member state is one of the foundations of the European Union. Many EU and UK citizens have made their life decisions on the basis of rights related to the free movement of people under EU law. The section on citizens` rights in the VA is unchanged from the VA, which was previously negotiated by the government in May. Although some provisions are controversial, citizens` rights have been adopted at a relatively early stage in negotiations between the EU and the UK. The third part of the European Union Withdrawal Agreement (WAB) Act contains, under united law, the provisions relating to the protection of citizens` rights in the Withdrawal Agreement (AV) and similar separation agreements with Switzerland and with the EEA-EFTA states – Iceland, Liechtenstein and Norway – under UK law. The only exception is for children born after withdrawal from the United Kingdom for whom a parent who is not covered by the withdrawal agreement has sole custody under applicable family law. The Authority and the European Commission inform each year of the joint committee established by the withdrawal agreement of the measures taken to implement and enforce the rights of citizens within the framework of the agreement. This information should include, among other things, the number and nature of complaints dealt with, as well as any follow-up of legal action taken. The citizens` rights provisions in the VA establish a framework for the continuation of legal residence (and related rights) of EU citizens residing in the UK and British nationals living in the EU at the end of the transition period (or the “implementation phase”). Individuals can rely directly on the VA to assert their rights. The provisions apply only to persons who are in a cross-border situation at the end of the transition period (WAB explanatory notes are called “protected cohort”).

The IMA will oversee the UK`s implementation of civil rights parties. The European Commission will play the same role on behalf of EU Member States towards British citizens living in the EU. Like the Commission, the IMA has the authority (but not mandatory) to make requests at the request of the Secretary of State, ministers of the decentralized territories or complaints from persons within the scope of the agreements.
